These terms apply to your use of listingmate.com.au and any related pages we run (the Site). The Site is operated by ListingMate (ABN 65 809 392 374) (ListingMate, we, us). By using the Site, you agree to these terms.

If your agency subscribes to ListingMate, your use of the ListingMate platform is governed by your agency's Subscription Agreement, not these terms.

If you use the Site on behalf of a business, you confirm you have authority to accept these terms for it. You must be 18 or older to create an account.

1. Using the Site

1.1 You may use the Site to learn about ListingMate, book a demo, contact us, and sign up.

1.2 You must not:

use the Site in a way that breaks the law or infringes anyone's rights;
try to gain unauthorised access to the Site or our systems, or interfere with how they work, or use the Site to build a competing product or service;
scrape, copy or harvest content or data from the Site using automated tools, except search engine indexing;
upload or send anything harmful, such as viruses or malicious code; or
pretend to be someone else or give us false information.

1.3 We may change, suspend or stop any part of the Site at any time. We are not obliged to provide support for the Site.

2. Accounts

2.1 If you create an account through the Site, you must give accurate details and keep your login secure. You are responsible for activity under your account. Tell us promptly if you think someone has accessed your account without permission.

3. Privacy

3.1 Our Privacy Policy and Cookie Notice explain how we handle personal information collected through the Site. If these terms and the Privacy Policy conflict about personal information, the Privacy Policy applies.

4. Our content

4.1 We or our licensors own the content on the Site, including text, graphics, videos, logos and software. You may view and share links to it for your own information. You must not copy, republish or use it commercially without our written consent.

4.2 ListingMate and our logo are our trade marks. You must not use them without our written consent.

5. What you send us

5.1 If you send us feedback or ideas, we may use them without paying you or naming you.

5.2 If you send us content (for example, in a demo request), you confirm you have the right to share it.

6. Information on the Site

6.1 We try to keep the Site accurate and up to date, but it is general information only. Examples of AI-generated content on the Site are for demonstration and may differ from what the platform produces for your listings.

6.2 Prices and features shown on the Site may change. The terms of your Subscription Agreement and Order Form apply to any subscription.

7. Third-party links

7.1 The Site may link to other websites and services. We do not control them and are not responsible for their content or how they handle your information.

8. Your rights under the Australian Consumer Law

8.1 Nothing in these terms excludes, restricts or changes any rights or remedies you have under the Australian Consumer Law or any other law that cannot be excluded.

8.2 Subject to clause 8.1, the Site is provided "as is" and "as available", and we do not promise that it will be uninterrupted, error-free or free from viruses.

9. Liability

9.1 Subject to clause 8.1, we are not liable for any loss arising from your use of, or inability to use, the Site, except to the extent the loss is caused by our negligence, breach of these terms, or fraud.

9.2 Subject to clause 8.1, we are not liable for indirect or consequential loss, or loss of profit, revenue or data, arising from your use of the Site.

9.3 You are responsible for any loss you cause us by breaching these terms or misusing the Site, except to the extent the loss is caused by our own conduct.

10. Ending access

10.1 We may suspend or end your access to the Site if we reasonably believe you have breached these terms. Clauses 4, 5, 8, 9 and 12 continue to apply.

11. Changes to these terms

11.1 We may update these terms. The latest version will always be on the Site, with the date it was last updated. If we make a material change, we will also show a notice on the Site or email account holders. If you keep using the Site after an update, the new terms apply.

12. Law and disputes

12.1 These terms are governed by the law of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.

12.2 If you have a concern, please contact us first so we can try to resolve it.

13. General

13.1 You agree to receive notices from us electronically, by email or on the Site.

13.2 If any part of these terms is unenforceable, it is severed and the rest continues to apply.

13.3 A failure or delay by us in enforcing these terms is not a waiver.

13.4 You may not transfer your rights under these terms. We may transfer ours to a buyer of our business.

14. Accessibility

We aim for the Site to meet the Web Content Accessibility Guidelines (WCAG) 2.2 at Level AA. If you have trouble using any part of it, contact us and we will try to help.
