Terms of Service

These terms govern your use of the ListingMate website and application (the “Service”). By using the Service you agree to them. If you are agreeing on behalf of an agency, you confirm you have authority to bind that agency.

The service

ListingMate generates marketing copy and branded assets for property listings, sequences a posting campaign, and publishes approved posts to the social accounts you connect. The Service assists your marketing; it does not provide legal, financial or real-estate advice.

Accounts and eligibility

You must provide accurate account details and keep your credentials secure. You are responsible for activity under your account and for the users you invite. The Service is intended for licensed real estate agencies and their staff in Australia.

Your content and listings

You retain ownership of the listings, imagery, branding and other content you provide. You grant us the licence needed to process that content to deliver the Service. You are responsible for having the rights to the content you upload and for the accuracy of your listing information.

Approval and publishing

Nothing is published to your accounts until a person at your agency approves it. You are responsible for reviewing each draft and for ensuring published material complies with applicable advertising, real-estate and consumer laws, and with each platform’s own terms.

Acceptable use

You agree not to use the Service to publish unlawful, misleading or infringing content, to breach a third-party platform’s terms, or to attempt to disrupt or reverse-engineer the Service.

Third-party platforms

Publishing relies on third-party platforms (such as Meta) and on the CRM or feed providers you connect. Their availability and terms are outside our control, and we are not responsible for their acts or outages.

Intellectual property

ListingMate and its software, design and brand are owned by us. These terms do not transfer any of our intellectual property to you beyond the right to use the Service.

Fees

Paid plans are billed as set out at sign-up. Indicative pricing on the website is for the demo and may change.

Disclaimers and liability

The Service is provided “as is” to the extent permitted by law. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Subject to those rights, our liability is limited to the fees you paid for the Service in the three months before the claim.

Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these terms or to protect the Service. On termination, we will handle your data as described in our Privacy Policy.

Governing law

These terms are governed by the laws of Queensland, Australia, and the courts of that state have jurisdiction.

Changes

We may update these terms from time to time. We will post the updated version here and change the “last updated” date.
